A guide to the Legal Process involved in Moving House
This is how we will proceed with your sale/purchase:-
When we receive instructions from you that you have sold your property and/or found one to buy the following procedures will commence (for registered land):-
We will contact the solicitors acting for the purchaser of your property and the seller of the one you are to buy.
With regard to your Sale we will:-
Before Exchange of Contracts
- Obtain the Title Deeds from the mortgage company, if held by them, or yourself
- Secure Office Copy Entries from the Land Registry
- Arrange for you to complete some transaction forms relating to your property or request sight of the HIPS report for the property, as appropriate
- Draft the contract and send it to the purchaser's solicitors for approval
- Reply to any further enquiries raised by the buyer
- Arrange for you to sign the contract

Exchange contracts and agree completion date
Between Exchange and Completion
- Reply to buyer's Requisitions on Title
- Approve draft Transfer
- Obtain the redemption figure of your mortgage (if applicable)
- Prepare discharge of mortgage undertaking
- Arrange for you to sign the engrossed Transfer
After Completion
- Deal with the Completion and report to buyer when keys can be released
- Discharge the mortgage (if applicable)
- Supply DSI to buyer (if applicable)
With regard to your Purchase we will:-
Before Exchange of Contracts
- Check the draft contract received
- Make the following searches; Local Search, Land Charges Search, Index Map Search, Environmental and Water Search, Chancel Check (where appropriate)
- Make pre-contract enquiries of seller and check replies
- Arrange for you to sign the contract and report to you on our findings
- Exchange contracts and agree completion date
Between Exchange and Completion
- Prepare Requisitions on Title
- Send off Report on Title (if mortgage)
- Prepare draft Transfer and send to seller
- Engross the approved Transfer
- Arrange for you to sign the Transfer (if necessary) and
the mortgage deed (if mortgaged)
- Arrange for you to sign the Land Transaction Return from and complete the form on your behalf where required
- Obtain the funds from you or the mortgage company to complete the purchase
- Make an H M Land Registry search
- Make a bankruptcy search (if mortgaged)
After Completion
- Deal with the Completion and report to you when keys can be released
- Arrange to pay the stamp duty due to the Inland Revenue where applicable
- Apply to the Land Registry for the Deeds to be changed
- Upon return of Deeds check they are in order
- Supply copies of the Confirmation of Registration to yourself and your mortgage company (if appropriate)
